Software License

The kanros CLI, GitHub Action, VS Code extension and SDKs are proprietary software provided free of charge under the license below. The hosted Kanros Cloud platform is governed by the Terms of Service. Every release archive also ships THIRD_PARTY_NOTICES with the licenses of the open-source components kanros includes.

Releases up to and including v0.1.0-rc.3 were distributed under Apache-2.0 OR MIT; copies of those releases keep those terms.

Germany ("Licensor"). All rights reserved.

This license governs the kanros software: the `kanros` command-line
binary, the GitHub Action image, the VS Code extension, the client SDKs,
and their documentation (together, the "Software"). The Software is
proprietary. It is not open source.

1. GRANT. Subject to this license, Licensor grants you a free of charge,
   non-exclusive, non-transferable, non-sublicensable, revocable license
   to install and use the Software, in object code form, for personal and
   for internal business purposes, including in continuous-integration
   systems you or your organisation operate.

2. RESTRICTIONS. Except as expressly permitted by mandatory law (including
   §§ 69d and 69e of the German Copyright Act, UrhG), you may not:
   (a) copy the Software, except as needed for the use permitted in
       Section 1 and for backup purposes;
   (b) sell, rent, lease, sublicense, or otherwise distribute the Software
       to third parties, or offer it to third parties as a hosted or
       managed service;
   (c) modify, translate, decompile, disassemble, or reverse-engineer the
       Software, or create derivative works of it;
   (d) remove or alter any proprietary notices, labels, or license texts.

3. KANROS CLOUD. Use of the hosted Kanros Cloud platform is governed by
   the separate Kanros Cloud Terms of Service (https://kanros.dev/terms),
   not by this license.

4. THIRD-PARTY COMPONENTS. The Software includes third-party open-source
   components. They are licensed to you under their own licenses, which
   are reproduced in the THIRD_PARTY_NOTICES file shipped with the
   Software. Nothing in this license limits your rights under those
   licenses.

5. OWNERSHIP AND FEEDBACK. Licensor retains all rights, title, and
   interest in the Software. If you send suggestions or feedback, Licensor
   may use them without obligation to you.

6. NO WARRANTY. The Software is provided free of charge. To the extent
   permitted by law, it is provided "as is", without warranty of any kind,
   express or implied.

7. LIABILITY. Licensor is liable without limitation for intent and gross
   negligence, for injury to life, body or health, and under the German
   Product Liability Act. For slight negligence, Licensor is liable only
   for breach of an essential contractual obligation (Kardinalpflicht),
   limited to the foreseeable damage typical for this type of contract.
   Any further liability is excluded. Because the Software is provided
   free of charge, Licensor's liability is in any case limited to intent
   and gross negligence to the extent permitted by §§ 521, 599 BGB.

8. TERMINATION. This license terminates automatically if you breach it.
   On termination you must stop using the Software and delete all copies.
   Sections 4 to 9 survive termination.

9. GOVERNING LAW. This license is governed by the laws of the Federal
   Republic of Germany, excluding the UN Convention on Contracts for the
   International Sale of Goods. If you are a merchant (Kaufmann), the
   exclusive place of jurisdiction is Berlin, Germany. Mandatory consumer
   protection laws of your country of residence remain unaffected.
